I have another accident to add to the tally!!
Coming home from ellys with bex about an hour ago, riding down the A12, outside lane when some dude in a coca cola van decides he wants to be in the outside lane too! so across he comes, no signals, i manage to move across just enough to avoid running into the back of him, insted he hits me totaly side on!:shooter how i stayed on the bike i dont know but i did. pulled over just before the hatfield peveral turnoff, hes behind me, go through the routine as you do...we do a check on his signals and none of them work!!! just my luck eh!:(
he accepted responsibility (we'll see if he says the same to the insurers, he more than likely will, because it'll be his company insurance he goes through. they have a duty to make sure his vehicle is road worthy, although that doesnt stop him checking himself before he sets off!!)
i'll post photos of the damage tomorrow!...im just annoyed coz my lovely paint job is now trashed!!!:( :(

Yeah, id of thought Coca-cola wouldn't want it hanging over them so if the indicators aint working they'll pay up quite quickly.

Shane glad your okay mate, but why didnt you call the Police??
You would have him banged to rights without having to worry about whether or not he decided to change his story later ;)
Any other witnesses other than you and the driver? i am assuming Becky saw it all, did the van driver have anyone else in the van with him?
As far as company policies go, there isnt a company out there that will admit liability for the the vehicle not being road worthy when they have a driver that can be held responsible, and in all fairness thats how it should be, its the drivers responsibility to ensure that both his vehicle and any cargo he is carrying is both road worthy and carried correctly, if they have a bump then its down to them then ;)
I will keep my fingers crossed for you fella, how bad is the damage??

hope fully there will sort it out quick . you need to phone the depot up and let them know, just in case he forgets to say any thing when he gets back to the yard, us lorry drivers do have a short Memory some times :grin2

that is on the button what happend to me i stayed on the bike too but mine dident get beat up to bad thoughi think its going to be a shok whne the insurance copnies find out you ppaint job cost £100,000000 being a one off and all

hes hurt his elbow and knee, but i dont no how he stayed on. didnt no about the police thing, but shane is going to get intouch with them today, is this gona be too late?
the bikes pretty bad, the crashbung has bent right back so its touching the enging, the fairings pretty badly cracked and a load of the paint job has been removed, indicators been torn off and so has the bar end, and the srceen.

If there is damage and injury then i will without doubt call the Police, to start with you get a reference number for the insurance to use as evidence, because basically the Police can apportion blame there and then as "experts".
Also they would report the fact that he couldnt have indicated because he didnt have working indicators that then makes the vehicle unfit to drive and straight away you have a situation where the biker didnt have a clue about the drivers intentions and as such couldnt have forseen it.
Ringing the Police today would certainly be the thing to do, as would going to the hospital to get that checked out, believe it or not he will likely get more from this muppets insurance company for getting a few knocks to himself rather than the bike, and the fact that he has presented to a hospital within 24hours to get injuries looked at goes even further onto the drivers blame.
I was never one for the compensation culture, but unfortunately a lot of people are falsely led into believing that insurance goes up because of how many accidents happen etc, its sod all to do with that for the most part, its because they can raise it and lower it at will, so make sure that your insurance Shane gets what you deserve, in fact if it was me, i would probably be taling some legal advice from them to see where you stand about pushing it.
As far as the Police go, you should report the matter anyway, not just for the fact that you have been hit, but because the pillock was driving without due care and attention, and also with a defective vehicle, they would have quite happily thrown the book at you for having a small plate and noisy can and its all too often that this ends up looking like a bikers fault.
Sorry if it sounds like a rant, but in truth the further i got down the page, the more ****ed off i got thinking about how much we spend on our bikes, how much we enjoy riding them, only to have a **** that needs 6 eyes and at least another brain to replace their defective one, simply because they cant keep something with 4 wheels in a straight line when we manage it quite easily on 2 ;)

if there is damage to person or property you should always call the police. ring them today and see what they say, hope it all works out ok. and i second/third lateshift's rant xx

went to the polioce station today, said that i know i shouldve called them straigh away but the shock meant i just wanted to get home, besides, i wasnt hurting then! today however is another story, man imy elbow hurts, and my little finger i cant even touch without a shooting pain, gonna pop down the hospital to get the elbow looked at i reckon!
As for the police they said that because we exchanged details its a thing for the insurance and not them, however when i mentioned the indicator thing, she took the reg number as is going to pass it onto traffic!
coz i have legal cover the woman i spoke to said everything i submit to them will be covered and recouped, so that'll be new tank, fairing, screen, crash bungs PAINTJOB and clothing!

legal insruance is so worth it, i know most people don't bother for £20 but its a good thing in cases like these.

if he'd pulled across a little earlier id have gone into the back of him and it would have been classed as my fault, a bit later and hed have hit my rear end and spun me off and id have been either slding down the road or catapulted into the armco barrier which wouldve meant lots of broken bones if not worse!!
its only now that ive started thinking about it!!

Pictures are pretty tasty dude, you had a lucky one with that, if you can actually call that lucky that is ;)
Insurance will be all over that like a rash so make sure you get whats coming to you ;)
It wont affect my premium that will go up and down all year long just like the petrol so get what you can :D

Im gonna put a list in for everything, new fairing, tank, screen, crash bungs, barends, clothing, paintwork! you name its being listed! now i have that spare tank i was after for my track days!

Again, something i thought of the next morning! my legal people have assured me though, that because all the damage is to the side of the bike it will be deemed his fault regardless so i'll be alright!
What about all your personal effects that where in the TANK BAG............................................... ......:grin1 :grin1

yeaj im putting in for new bike gear, i'll get a new one piece when the money comes through.
i did mention the paintjob to the insurers when i was making the claim, although it wasnt declared the legal cover can still get it sorted for me through crafty wording!

LEFT BRAKE DISK (although i'll get a pair sorted) Pulled a chunk of what looks like plastic from inside the caliper this morning. having investigated it looks like the disk has been knocked out of shape a bit because a section of the disk (about 1/5 turn) doesnt make contact with the outside pad and the rest does, this means the pad is not rubbing slightly like it should do so it releases from the disk surface and the pad moves in the caliper making a really annoyng "tink" noise everytime the wheel goes round!
becky's gonna fax the total off for me tomorrow, so then its just a matter of waiting!!

The one thing you have to remember though, is the more you claim for on the bike, the closer the total will get to the total value of the bike, and the more likely they are to write it off.
The people that picked up my VFR said they write off 8 out 10 bikes, because they use all new stuff, and the best mechanics etc.
I'm not sayin they'll write yours off, but if the costs keep going up they'll just give you a cheque and a slap on the back.

**ahem** im a bit annoyed though at the moment to be honest, i was all set to head out round to bex and the Bugger wouldnt start...got me FI fault light flashing away...turns out the fule pumps not working so the bike wont start!! not impressed coz the fella at wickford motorcycles cant pick it up till tuesday!!! gonna try for that loan bike now!!!

I dont know, ive never had a problem with the fuel system before, so it seems funy that a few days after the accident all these little things start going wrong...its just really annoying coz it was working fine the last few days, then al of a sudden, over night, its just packed up!!

:laugh1 :laugh1 i just got off the phone to the legal bods dealing with my claim and they said i can claim for the work on the fuel pump and stuff too...because theres damage to the tank its obviously caused this problem to arrise!!

Right...i dont want the bike anymore it f*****g crap!!
Got it back from the fuel pump reapir, still a few fault code flashing up...could possibly be the alarm causing it...rode it home today.....lumpier than a sack of spuds......smells rich, when i slow it down the bike is still reving at about 2500 then it drops down to tickover after a second or so!!
thng thats annoyed me more is the fact that i had to pay for the original problem, but when i came to take it it didnt work, on inspection the fella discovered something else it could be so cahrged me another load of labour for it...i was suppposed to use that money to take bex out for dinner for our anniversary!!!
im so f***** off!!!!!
