wake up this mornin to snow, quite happy then my mom says i've had a letter from the solicitors (regarding my accident)... the woman who hit me has said in her statement that she crept out and i rode into her bumper,(so what i just magically did a superman across 2lanes and a curb?!)... then there was an off duty policeman in the traffic who was about 40-50 metres away said he could see the car while i was going up the side of the traffic..(the road bends round so where he was he probably could but not where i was)... then one of the witnesses has drawn a picture to say i was filtering along and rode straight into the side of her!!!!.... when everyone else has said i went into the right-hand lane and then swerved to avoid collision as i saw her at the last second..... im not sure what is going on with this but i don't see it being settled any time soon:mad: :(
the woman who hit me knows full well she pulled out into me and she knows full well that she didnt creep out but shot out!

When you say she hit you, was it square on i.e bumper to side o bike?
Or was it front of bike to flat side of car?
Or was it wheel arch to front wheel of bike?

You have to get this clear in your mind. It does not matter what anyone says, it is down to the evidence and facts. This will be recorded by the police officers at the scene of the accident. They will record damages to both vehicles and interview both drivers and witnesses at the scene.

The courts will try to reconcile the statements to the damages on both vehicle and then decide who is at fault.

So don't fret, just tell it like it was and you should be ok.

Yea mate, being in pretty much the same scenario as you i feel for you buddy! The woman who hit me is STILL trying to claim i was speeding, the policeman asked me at the time, i said max speed of 30mph, he looked at me, looked at my bike... and said... 'Yeah i dont think you could of got faster than that..':laugh1

Now usually, id argue the speed of the CG125.. but no, it IS of course the slowest accelerating bike under the sun!:grin1

The policeman turned to the woman and asked her side, she said she was pulling out and i hit her (Her Fault, im right of way!) Policeman told her it was my right of way then, and she still said i was speeding, he looked at her, looked at my bike and laughed telling her to just get in the car..:grin2

Filtering is a dodgy circumstance, if a car driver thinks they can get one over you because you were filtering then they will..

The thing that gets me is that the woman that hit me was fine, until her husband turnt up, she apologised, i didnt see you she says, but when her husband turnt up she says 'i was pulling out and this lads shot down here and hit me in the side!' You what love???

Her husband tried knock for knock and everything, thinking we wouldnt get the police involved...how wrong were they!! :D:D:D:D

lol... this woman made it sound like i'd gone into her wheel arch but it was the left headlight and that side of the bumper that hit me on my leg so dead in the centre of my bike and i was coming from her right! so how she can say that i dont know.... also at the time of the accident i wasnt actually filtering.. i was in my own lane as she hit me!... im sure it will go my way it just means that i am going to have to wait ages for this claim to go through!!!... which isnt too great

And of course you both were treating every car as a potential hazard and as such these accidents never happened as you were prepared for the unexpected?

so if that is your opinion how do i treat a car i cant see as a potential hazard?????? i dont have x-ray vision btw :)

Plan ahead. Keep your eyes and options open. All hazards, unseen and visible are avoidable if you always ride defensively. Not popular opinion with those that like to scream their bikes to the limit at every opportunity but its kept me safe all these years.

well funny you should say that about people screaming their bike to the limit because if i was going flat out the accident wouldn't have happened... but seeing as i thought i'd stay to the speed limit, i think i was doing the right thing.... also if you dont see something untill its hit you how is it avoidable?

if i was planning ahead and looking round everywhere for a car that might hit me.... who is looking straight ahead at the things infront....
i have a feeling all this is because i ride a 50cc and when you think of a 50 cc rider you think stupid chav teenager ragging the tits off his moped and to be honest i usually do but at the time i was riding properly not doing anything wrong as far as i know...... and if i was then the CBT is not good enough because all i had to do was my CBT, is there anything in the training that teaches you about accidents other than the emergency stop? i believe not... so not my fault if i am lacking in experiance and knowledge

Yes I was being sarcastic. It's my nature. Sorry.

I was hoping to put across that nearly all [maybe not yours] accidents are avoidable.

Treat every car driver as an idiot,[me included when i'm in the cage],look for every line of cars to have some pillock waiting to crop you, every junction for the driver to pull out even when they have looked straight at you and I hope you get the gist.

And mate...We all started somewhere. 50cc or no. We all had to learn.. I started on AP50 Suzuki many years back.

its cool:grin2 ..... it just came across like alot of peoples opinions that a 50cc rider is a crap rider and because lets face it knowbpdy likes a moped lol

:grin2... im hoping to fix the bike up soon anyway!! so will be back on the road ASAP!
