Ok so you might have read my earlier thread about the letter from the nagging neighbour? If not shame on you!

Now this morning I recieved another letter. It reads:

Enviormental Protection Act 1990
Noise Nuisance - ** Dafodil Way, Chelmsford, CM1***

I regret to inform you that this service has recieved complaints alleging nuisance caused by the revving of your motorbike early in the morning and late at night.

Whilst the complaint is currently only an allegation, I request that you consider if such noise is likely to cause disturbance th nearby residence. If so, your prompt action in resolving this matter would be appreciated and will prevent further action being taken.

For your information I have enclosed a leaflet which details legislation available to deal with noise nuisances....

I mean what the ****?
The bikes been off the road a week.
I wonder if the moron up the road with the bandit got a letter.
I wonder if that spaz in the mini with 1000 exausts got one.
I wonder if the sodding kids got one for talking on the way to school.
I get up and go to work. I come home from work. At any one time they hear my bike for a few seconds. I dont leave that early and never come back late. What is up with these people. My exaust has the baffle in now!

go knock round the bandit guys house and ask if he got one, i recon its someone over the road from you, trying to scare you into getting ride of the bike, id just keeping make the same amount of noise, go round knocking you'd probably soon see who sent it,
does it have a postage stamp? and marked by the post office? if not deffently someone down you're road

Its an official letter from the council mate! Not a fake.
I just called him to tell him how delighted I was. He implied that it was someone close to my house unable to tell me who. But I told him should they call him again that they should come to me and tell me to my face, im not unreasonable but I do feel that I dont actually sit and rev the bike on the diveway. Apart from one time when I was setting up my shift light and that was in the daytime

i cant realy screw as i jus reported the people next door to me to the council, but then again, theres a difference between what you've been accused of, and playing ****ty 80's music loud and 3 in the morning

some people are scared to approach people face to face, for wahtever reason.

if it was me i would write back and explain calmly and politely that my bike was my only form of transport and that i used it going to and from work etc....but i wouldnt say anyhting about minimising any noise where possible becuase that would then imply that you are aware its noisy.

the council may be able to supply exact dates and times where the noise has caused particular offence and then you could go from there? surely you are entitled to know exactly when the noise has taken place?

I basically said that.
He said that he wasnt able to disclose any information.... I was like well how can I avoid ****ing them off if I dont know what times its annoying them or where they are etc!

the council will tell you the incident time/date if they have been given it. But you have to ask nicely :reading!!! All that letter is, is a generic information letter. The individual that complained would have received a log sheet, he would have to feel this in over a period of weeks to show the noise is regular and unecesary. Once they have that info returned they can act, if they need to !. If it is a one off complaint they will go thru the motions then file it:grin2

Just a tip, the noise bloke at the council is the one you want on side, dont **** him off or you will be in trouble. They arent stupid and they have to go thru the motions, but they dont take action unless they have sufficient evidence to prove you are being a nusance, which in the first instance is down to the other party to prove. Also they now the difference between someone putting up with a real problem and someone who is just trying to drop someone else in it !:rolleyes:

Personaly I would just make note every time/date you leave your home for the next couple of weeks, a pain, but the only thing you can throw back IF the other person is filling out a log (chances are he will exagerrate !)

If they have the powers to shut a pub down, then your bike will be no probs for them. :grin2

you should arrange a big ride out from yours early on a Sunday and make sure you invite some very quiet Tl's lol

ha ha yer I thought that when I was on the phone. When my bike Idles its pretty quiet. But if I still had my SP1 they wudda thought there was a spitfire taking off on the driveway!

well thats just stage one

started with him playing his music and argueing at 3 in the morning, after the 4th time i knocked and got told to **** off, his also the dad of someone i used to work with, and i knew his mum and he used to beat her so i have no sympathy, he tried sitting on my bike when he was ****ed also so even more reason

jus couldnt help but laugh when i was laying in bed and heard "urgh i got **** on my hands"

If your bikes been off the road for a week, you just want them to complain now, that will put you in the clear won't it.

As the Guv'nor says, don't alienate the Guy from the Council, you want him on your side. Hope you get the bike back on the road soon, but keep the baffles in for the time being if you do.

I have nagged my Son about the noise he makes, his argument is that my can is not legal either, but I pointed out, firstly, my can may not be strictly legal, but is only a std Akropovic and not excessivly noisy, whereas his has next to no packing in it either and makes a lot of noise, then of course, my bike is for fun only, so doesn't tend to go in and out at extreme times of the day, whereas, his is his only form of transport, so he goes out in the mornings and sometimes comes home at 11:30pm.

You won't win this one by ****ing people off, or fronting people up, you will only win this one by tact and diplomacy, being the nice guy and keeping the noise down for a while.

you could always force the neibour into making a false complaint, you have obviously got documents to prove the bike is of the road, get a m8 with a similsr bike keep it out of sight & rev the boll**ks off it!!

I did this & then when the councill came down to see the problem my mum said "what that bike there? you mean the one with no engine was revving loudly last night?......I dont think so cos the engine is in that crate there!"

now when thers a complaint it seems to be dismissed!! lol

but not the best way to deal with it i suppose!!

if your only warming it up before setting off, then coming home they cannot do nought, i park mine outside my front door, and turn it off there, there is no way im pushing it to the end of the road just to keep the neighbours happy, live and let live
