I am absolutely SICK of incompetent Ebayers!

Wrong goods, faulty goods etc.

Recently I have had

defective car stereo (new) faulty....never resolved, they replaced the front panel then the remote didn't work anymore
m/c boots (new) wrong boots sent
pair car shocks (new) faulty, one defective, still awaiting response
m/c clutch cable (new) sent a SPEEDO cable instead of a cutch cable
tv (new) faulty, eventually refunded




The Distance Selling Regulations issued by the Dti and the OFT, state that if they send wrong or faulty goods they should send the correct goods and collect the wrong ones. ...Easy innit? ....The trouble is that when these people have screwed up, they don't seem to know what the DSR's say. The return of faulty goods is their responsibility, the buyers responsibility is to make the goods available for collection......what is more they expect me to pay for the return because they got it wrong! AND they won't send out the correct gear until they get the duff goods back AND they expect me to leave them feedback first, so that if I leave them bad feedback they can retaliate! So I compiled this to send to one of them.

XXXXX, I was not being ratty with you, but I am now, after that. If you wish to sell by post, may I suggest you aquaint yourself with the Distance selling regulations as issued by the OFT and the DTi http://www.oft.gov.uk/shared_oft/business_leaflets/general/oft698.pdf
In short, your mistake, your problem, you sort it, if you want the wrong cable back, my obligation to you is to make it available for collection, which I have clearly already stated it is. I no longer wish to do business with your company. Please cancel my order and refund all monies paid including postage. You will find if you take the trouble to read the above, that you should do this as soon as possible and it is NOT dependant upon getting this wrong cable back. I am not interested in any further communication, refund or open an Ebay dispute! but I suggest you read the above link first. I have given you two opportunities to resolve the issue, I am now giving you the opportunity to redeem yourself by promptly refunding.

I can afford to lose the price of the cable but when I have already told him the bike is off the road awaiting this cable, he could at least fulfill his obligation and send me the correct cable!

Where do you stand on the I bought something and paid for it. Then find out there cock up and have sold 25 instead of one item. I was a winner and about 48 hours later sent a message saying that I was not a winning bidder as they messed up.


Ebay have some good and some bad sellers. Some you get lucky with some are idiots.

An Auction is a contract, the buyer must fullfill their part which is to pay, the seller can either fullfill theirs and supply goods as described OR Nullify the contract so that the buyer is restored to the same state as before, ie. a full refund including postage even if postage costs have been incurred.

......and the only dispute a seller can raise is non payment, so my seller has not even got a basis to raise a dispute!

One other thing that annoys me on ebay is the cost of P&P. Some ask stupid prices for the delivery that you know only cost a few quid and they want £10 or something stupid. Stuff I sell has a resonable price. I have even lost out on P&P due to costing more than i thought.

Anyone into star wars as I have loads of stuff on there now.

i sold my surround sound put 10quid for postage thought that should do it i reckon well i went post office saw it could be 4.40 i thought well cock up there but bonus, nah when weighed it came in at just over ten quid i was like bolllocks didnt expect that

Well i been selling bits last week & nobosy has complained about my postage rates, i put £8 on them for postage, i have sold all my fairings & most have been paid for..... i think you have got to be a bit rude to expect to win a srad fairing for 99p & then refuse ,me £8 postage!! otherwise hows it worth my time!!!

No its just some idiots messing about for publicity they never got, trying to make out they have sold a heinz bake bean can for 250 quid when the seller mentions the buyers name... me thinks not... funny but not real.:reading


Actually i havent PERSONALLY had a problem with ebay as of yet (touch wood) but my dad has.. namely when we sold our toyota and the stupid nigerian bloke managed to haggle my dad down from the original price bid (almost 900 quid) down to 600!!

Unfortunately ive deleted the email now, but i emailed the guy asking to leave feedback.. so obviously on our part it was a positive and then i left him a negative, saying he did not pay the price he bid, made up faults with the car, and wasted our time.:grin1

The response back was v. rude and inpolite something about him having to travel halfway across the country to collect a car with faults such as

'Heaters didnt work' - Total Bull as that car was used daily by my dad and we KNEW the heaters worked.

'Internal Damage' - Admittedly the switch for the moon roof had come away during a family outting and thus was held up with tape.. doesent affect the car at all!

'There was a rip in a seat'- Once again total bullsh!t as we had pictures of every seat in the condition it was sold in.

And for a finale 'The Exhaust was blowing' once again another made up story as the car was looked at by a mechanic not long before it was sold so if HE didnt spot it i very much doubt this guy would..

But unfortunately my dad gave in which i wish he hadnt as the car was worth a hell of alot more!!:shooter

So yeah theres alot of scammers and hagglers out there.. and MILLIONS of timewasters.. i know as i was one with a guy who offered me a second chance offer which i declined as i could not buy the item anymore.. although he went to the trouble of putting it up.. he was kind enough to understand and give positive feedback though.. so all worked out well and to date i have NO negative feedback!:grin2

no no this was INFACT actually an Akropovic can for my bike! i asked him to do a *buy it now*but i might not have have got home in time to actually buy it....so asked him to make it something no one would buy! Thats why he is saying its just for me!???! hehhehehe i thought it was funny anyways!

But the question is Jon, why go to the trouble of lining Ebays pockets to do it, why did he not just send you a paypal invoice and do it off ebay.

Well the progress is that they have written back, they told me I should "grow up! "

.....So I have forwarded all communication on to Trading Standards, and offered to send the cable to Trading Standards and asked them to give him a nudge, ......lets see if he tells them to grow up?

The thing that REALLY annoys me with ebay is you buy something, you pay and thats when your meant to get your feedback as you've held up your part of the deal and as far as feedback is concerned your finished.

However, about 99.99999999999999999% recurring don't, they wait till you've left your feedback.

Then if you have to leave bad feedback they then scréw you over with bad feedback when you've done nothing wrong! bástárds.



Went on a ebay rampage yesterday, bought 8 items. only logged on to have a browse while i was bored! :|
