View Full Version : Dishonesty, bandits hidden history.

Well the story goes.... Bought the bandit from "WOTBITZ" in romford next to sudden impact. Bike looked reasonable rode nice, had a years MOT. I asked all the usual questions, is it HPi clear everything works etc... And was reasured by the dealer that everything was hunky dory. I took the bike the MOT and the slip away. He took the V5 as most dealers do and we were all happy as larry.
After 4 weeks, no V5. So I call the dealer..... Wheres my V5 mate? I was constantly reasured the company had posted it and that it can take up to 6 weeks. So 2 weeks on still no V5. At this point my ninja is getting ****ed in the salt and sleet of winter as I am unable to tax or insure the bandit due to lack of a V5 and had misplaced the green slip. Call them again mate wheres my V5? We sent it he says bla bla. So I call the DVLA. They never recieved anything. So after lots of abusive phone calls from me and lots more hassle the bloke who was manageing the place suddenly isnt the manager there anymore. My ninja's chain is orange with rust.... My back tyre is square. The bandit has not moved.
I now want to get rid of it.... I call the dealer. Sort out my ****ing V5. So they pay for it. Great! Now I want re-embursement for my tyre and chain which are ruined. Nope.... Not a ****y bird. They wont do nowt.
So I think fine.... Ill sell the bandit admit defeat and use the ninja maybe get sumik flashy for summer. Nice chap comes round has a ride. Seems happy. "Can I hPI the bike?" yea I say of course. So he leaves a deposit. And off he goes. Everyones happy??? No.....
He texts me saying that theres an issue with the VIN number. So confused by the fact that the dealer had said he had already HPI checked the bike I checked it on the RAC website. And now I am really ****ed.....
The VIN does not match the Number plate. Previously the milage for this VIN was recorded in 2001 with 49000 miles. My bike has 30000 miles, which also shows up in 2007 when it was MOT'd.
So.... https://www.hpicheck.com/consumer/checkReport.do?reference=EM11555802&vrm=R168NGN&source=RACLite
The dealers new manager said that the owners have said ****** to it all basically. I am entitled to nothing. Surely there must be some sort of legality due to the fact that I have been misled. Where do I stand here. I am very out of pocket here and feel well gutted.
Short smearing their company name over every mag I can think of what other action can I take?

Not good....
Not sure that this is the place for best advice, I'd be on the phone to citizen's advice sharp'ish.
Guessing you paid with cash? If you paid by plastic or finance, I'm sure that the card issuer or lender will take on the dealer on your behalf.
Good luck.

Just got some expert advice...
Basically looks like I am entitled to a refund due to sale of goods act - not fit for purpose, which I thought anyway.
And if the frame has come from another bike and they knowingly sold it to me apparently they can get in some doo doo

**** position that Jay.
I know what I would do and it would involve me and a few mates paying a visit and some instant insurance payouts on the rest of their stock.
As already said, golden rule, always, always HPI the bike yourself. Experian is the fav used by most decent dealers. And check all the numbers yourself. Ask to see the log book. match the numbers off it against the bike.
CAB is your best bet :

you need go through and work out your rights
i'd personally try to reject the bike and get a refund or demand compensation as the bike you brought is not the bike you thought you were buying.. so you paid over book price
and then there is the mileage issue
get to speak to the owner.. make them aware you are speak to cab and trading standards
(and any association the dealer maybe a member of)
and your next step is to talk to mcn / ride / etc..etc
failing that you could organise a rideout to the shop and we could all park outside explaining to each customer why we are there, handing out flyers explaining the situation

you live and learn.. hopefully the dealer is a member of a decent association that will take up the matter with them

This is so crap, to be treated like that by a dealer isn't it?
So post up the dealers name again in big letters so we all know who they are.....

i bought a bike from wotbitz as well and it took a long time to get the v5 and the bike was'nt as kosher as they made out to be,wotbitz dont tell any of their prospective buyers on ebay that they are directly linked to sudden impact.

There must be a way of getting him bad feedback on ebay. He has an ebay shop on there. But.... because I didnt buy in ON ebay I couldnt leave feedback
im confused..
obviously at some point in its history the frames been changed etc etc i get all that..
but how does that affect the bike.. does it need to be recorded??
Have you got the v5 now?? is it not a case of informing the dvla.. :eyewobble
Sorry n00b question but i just dont get it..:headbash

they definately have something to do with sudden impact as when i was getting my receipt and signing the paperwork i had to go into sudden impacts office.in all fairness the bike was'nt a pile of crap it just seemed to be not what they had made out.

Let us kow how this pans out dude!
hit up Citizens advice, Trading standards...everyone, im sure youre on it already!
I had a similar issue when i got my R1...nothing as bad as dodgy frames or HPI, but the whole V5 issue is far too familiar...even more so coz i was at one point running 2 different numberplates!!!!!

And I tell you what shane, it's not limited to second hand bikes. I've had loads of grief over V5's for my 636, 2005 R1 and my FZ1. I won't mention the dealers name but all the bikes came from the same place.
I had a DVLA inspector knock on my door asking to see the R1 6 months after I sold it. He wanted to check the frame numbers etc and I had tax reminders for it aswell.

Well not having the right numbers kinda gives out a few warnings as to why & more to the point, Ben should have been informed... & yep im pretty sure the DVLA would need to know as the bike is not the bike it's claiming to be...

Yeah i had a word with my dad earlier about it all, he said the best advice to give is that jay needs to talk to citizen advice to see his rights etc etc etc.
And if you have the V5 now..(?) then check all the numbers against the bike.. make sure you aint got a ringer ;)

Holy Sh1T mate thats really bad to hear!!!
We were only talking about the risks of ebay an why i bought mine well away from it! really sorry to hear that! hope it gets sorted!!:shooter
The bike never came from eBay it came from a dealer that also sells on eBay.
To be honest eBay is like anywhere else do your homework and cover your ar5e. I have bought 6 different bikes from eBay including my old Aprilia with no problems at all! ;)
